9. Open Source Software

You represent and warrant that you will not use, and will not authorize any third party to use, any Open Source Software (as defined by the Open Source Initiative) in connection with the Service in any manner that requires, pursuant to the license applicable to such Open Source Software, that the Service or software used to provide the Service be (a) disclosed or distributed in source code form, (b) made available free of charge to recipients, or (c) modifiable without restriction by recipients (“Prohibited Open Source Software”). With respect to any Feedback, you represent and warrant that such Feedback, in whole or in part, contributed by or through you, (i) contains no third party software or any software that may be considered Prohibited Open Source Software and (ii) does not violate, misappropriate or infringe any intellectual property rights of any third party. Prohibited Open Source Software includes without limitation any software, documentation or other material that is licensed or distributed under any of the following licenses: GNU General Public License (GPL), GNU Lesser/Library GPL (LGPL), Free Documentation License, Mozilla Public License (MPL), or the Common Public License (CPL).
